Terms of use

In short

By downloading and using Modfun, you agree to these terms. In short: enjoy the game, don't hurt anyone, don't cheat. The App Store and Google Play handle subscriptions and refunds.

What Modfun is

Modfun is a party games app where friends in the same room each join with their own phone. One person creates a room and the others join with a code. You need an internet connection to play.

Age

You must be at least 13 years old to use Modfun. If you're under the age of majority in your country, you should use Modfun, and especially make purchases, with the permission of a parent or guardian.

Accounts and guest play

• You can create rooms and play as a guest without an account. Guest data is deleted if you don't sign in for 90 days.
• If you create an account with Apple, Google or email, your history and stats are kept and you get more weekly plays.
• You're responsible for keeping your account secure; don't share your password with anyone.
• You can delete your account from inside the app at any time.

Free version and plays

• The person who starts the game (the host) uses one weekly play for that game; the other players don't use any.
• With an account, you get 5 plays a week for each game; as a guest, 2. Plays reset every Monday at 00:00 Turkey time.
• Players with an account can earn a limited number of extra plays per day by watching ads.
• The number of plays and what's included in the free version may change; we'll announce important changes in the app in advance.

Subscription

• The paid version is offered as a monthly or yearly subscription: unlimited games and no ads. Everyone who joins a room created by a subscriber sees no ads in that room.
• You need an account to subscribe. The purchase is made through your App Store or Google Play account, and the price is shown in the store before you buy.
• Your subscription renews automatically for the same period and price unless you cancel it at least 24 hours before the current period ends. Your store account is charged within the 24 hours before renewal.
• To cancel: on iPhone, Settings > [your name] > Subscriptions; on Android, Google Play > Profile > Payments & subscriptions > Subscriptions. Deleting the app doesn't cancel your subscription.
• If you cancel, your subscription stays active until the end of the period you've paid for.
• If a free trial is offered and you don't cancel before it ends, the paid subscription starts.
• If the price changes, the store will tell you in advance and ask for your approval where required.

Refunds

Because purchases are made through Apple or Google, they also handle refunds, under their own rules:

• App Store: you can request a refund at reportaproblem.apple.com.
• Google Play: within 48 hours of your purchase, you can request a refund from Google Play; after that, contact us through the Google Play help page or at info@modfunapp.com, and we'll help you under Google's rules.

Because digital content is provided as soon as you buy it, your legal right of withdrawal ends if you agreed to this when you bought it (in the EU, Article 16 of Directive 2011/83/EU; in the UK, the Consumer Contracts Regulations 2013; in Turkey, Article 15 of the Distance Contracts Regulation, Mesafeli Sözleşmeler Yönetmeliği). Your rights for a faulty service and your statutory consumer rights are always preserved.

Code of conduct

In the games, bluffing and lying as part of your role are allowed; that's the fun of it. But in real life, you shouldn't hurt anyone. The following are not allowed:

• harassment, threats, bullying, hate speech or discrimination,
• pretending to be someone else or using someone else's account,
• cheating, using automated tools, modified apps or exploits (if you find a bug, just let us know),
• overloading our servers, misusing rooms, or reverse engineering the app,
• copying, selling or commercially using Modfun, its content or its code without permission,
• any illegal behavior.

If you break these rules, we may suspend or close your account, with a warning or, if necessary, without one.

Nickname rules

Everyone in the room sees your nickname. So:

• It must be 2–16 characters long; you can use letters, numbers, spaces and . - _ '
• No swearing, insults, hate speech, or sexual or violent language.
• It can't impersonate a real person, a celebrity or the Modfun team.
• It can't contain personal information such as a phone number, address, email or link, or any advertising.

The app automatically rejects inappropriate nicknames. We reserve the right to change or remove any nickname that breaks the rules.

Intellectual property

The Modfun name, logo, characters, stories, texts, sounds and software belong to us or our licensors. We give you a limited, non-transferable right to use Modfun for personal, non-commercial purposes.

Changes to the service

We may add new games to Modfun, and change or remove existing features. If we shut Modfun down completely, we'll announce it at least 30 days in advance; for subscriptions that run past that date, the store's refund rules apply.

Liability

We put a lot of care into Modfun, but we can't guarantee it will always work without interruptions or errors. To the extent permitted by law, we aren't liable for indirect damage or for causes beyond our control, such as a lost connection. This limitation doesn't apply to intent, gross negligence or your statutory consumer rights.

Governing law

These terms are governed by the laws of the Republic of Turkey. If you're a consumer, you keep the protection of the mandatory consumer laws of the country where you live, and your right to bring a claim before the consumer courts or dispute bodies there.

A note about the App Store

If you downloaded Modfun from the App Store: these terms are between you and us, not Apple. Apple isn't responsible for maintaining or supporting Modfun. Apple's standard end user license agreement also applies, and Apple and its subsidiaries are third-party beneficiaries of these terms.
